SECTION A — CONTRACTOR PRIVACY ADDENDUM
1. Purpose of This Addendum
Explains how contractor‑specific data is collected, used, stored, and protected when Contractors access or interact with the Kluje Platform. Ensures transparency and compliance with U.S. privacy standards for business‑class cloud services.
2. Contractor Data We Collect
We may collect contractor‑specific information including business name, trade classification, licensing details, service categories, quotes, uploaded documents, communication logs, work history, performance metrics, and geographic service areas.
3. Use of Contractor Data
Contractor data may be used to match Contractors with projects, generate AI insights, improve platform accuracy, verify identity, support compliance tools, and enhance visibility. Contractor data is never sold.
4. AI Processing of Contractor Data
We do not use identifiable contractor data to train public AI models, sell contractor data, or allow third‑party AI systems to store identifiable information. We may use anonymized or aggregated data to improve platform intelligence.
5. Contractor Profile Visibility
Contractor profiles may be visible to property owners, investors, businesses, and platform users. Visibility settings may be controlled through the dashboard.
6. Data Sharing With Clients
Certain contractor data may be shared with clients as necessary for project execution.
7. Data Security
Contractor data is protected using encryption, secure hosting, access controls, and continuous monitoring.
8. Contractor Rights
Contractors may request access, correction, deletion, copies of their data, or visibility adjustments.
9. Data Retention
Data is retained only as long as necessary for platform services, legal compliance, dispute resolution, and record accuracy.
10. Compliance and Legal Requirements
Data may be disclosed when required by law, court order, regulatory authorities, fraud investigations, or compliance audits.
11. Changes to This Addendum
We may update this Addendum at any time. Continued use constitutes acceptance.

SECTION B — CONTRACTOR TERMS OF USE ADDENDUM
1. Contractor Eligibility
Contractors must be legally authorized, licensed (where required), provide accurate information, and be at least 18 years old.
2. Contractor Responsibilities
Contractors must provide truthful information, comply with laws, deliver services professionally, respond promptly, avoid fraud, and use the platform lawfully.
3. Quotes, Estimates, and Project Data
Contractors may submit quotes, estimates, pricing, scopes, and documents. Contractors grant a non‑exclusive, revocable license for platform functionality. Contractors retain ownership of their business content.
4. AI‑Generated Insights and Scoring
AI outputs (matching, reliability indicators, risk scores, cost modeling) are informational only and may not be error‑free.
5. Contractor Profile Visibility
Profiles may be displayed to users seeking services. Visibility settings may be adjusted.
6. Prohibited Conduct
Contractors may not misrepresent qualifications, submit fraudulent quotes, harass users, reverse engineer software or AI models, circumvent security, scrape data, or engage in unlawful behavior.
7. Fees and Payments
Subscription fees are billed through Shopify Payments. Fees are non‑refundable except as described in the Refund Policy.
8. Contractor Data Handling
Data is handled according to the Privacy Policy, Contractor Privacy Addendum, and DPA.
9. Termination
Access may be suspended or terminated for violations, fraud, chargebacks, security risks, or misuse. No refunds beyond the Refund Policy.
10. Governing Law
Governed by the laws of the State of Wyoming.

SECTION C — DATA PROCESSING ADDENDUM (DPA)
1. Definitions
Defines Customer Data, Processor, Controller, AI Processing, and Sub‑processors.
2. Roles and Responsibilities
Controllers determine how data is used. Divitiae Terrae LLC processes data only as instructed, does not sell data, and does not use identifiable data to train public AI models.
3. Purpose of Processing
Data is processed to provide SaaS/AIaaS functionality, authenticate users, deliver matching, generate AI insights, improve performance, prevent fraud, and comply with legal obligations.
4. AI Data Processing
AI systems may analyze Customer Data to generate predictions, risk scores, cost modeling, and matching. AI outputs are informational and not guaranteed to be accurate.
5. Sub‑processors
We may use sub‑processors for hosting, security, payments, storage, and infrastructure. All must meet industry‑standard security requirements.
6. Data Security
We implement encryption, access controls, secure cloud infrastructure, monitoring, and incident response protocols.
7. Data Retention
Data is retained only as long as necessary for services, compliance, and dispute resolution.
8. Data Subject Rights
Users and contractors may request access, correction, deletion, copies, or processing restrictions.
9. International Transfers
Data is stored and processed in the United States. Any international transfers follow legal requirements.
10. Breach Notification
We will notify affected parties promptly in the event of a breach.
11. Termination of Processing
Upon termination, Customer Data may be deleted or returned upon request. Some data may be retained as required by law.
12. Governing Law
Governed by the laws of the State of Wyoming.
